REAL Housewives of Salt Lake City's Monica Garcia has been accused of refusing to provide complete evidence of her botched injections and other lip and nose procedures, The U.S. Sun can exclusively reveal.
Heather Gay’s company, Beauty Lab + Laser, has been embroiled in an ongoing lawsuit against Monica, 39, after she failed to pay her $2k bill.
Monica had filed a counterclaim lawsuit against the medical spa, but as of January 17, it has been dismissed.
In attempts to settle the dispute and collect the debt, Beauty Lab filed a new doc, their Statement of Discovery Issues, notifying the court that they have yet to receive any discovery from Monica.
The January 29th filing, exclusively obtained by The U.S. Sun, claims the RHOSLC star has failed to fully disclose all relevant documents relating to any lip and nose injections she had gotten done by Beauty Lab or another facility in the past few years (five years prior to receiving injections from BLL in 2019-2020 and since then).
BLL's lawyer states that she had agreed to submit supplement by January 19, 2024, after an in person meet and confer, but then days before it was due, she filed a Motion for Protective Order in an attempt to not have to disclose certain discovery.
Beauty Lab points out that Monica objected to their discovery request back in December because "the request was overbroad, unduly, burdensome, and not proportionate in its demand for documentation for 'any cosmetic enhancements.'"
Heather's company has since worked with Monica and her counsel to "narrow down what was needed" and have since specified the discovery to be just "lip or nose injections or other sorts of lip or nose procedures."
'INADEQUATE' PRODUCTION
Beauty Lab slammed Monica and her attorney for submitting documents that it called "wholly inadequate."
"Fowler provided four photos, not in their native format, and nothing else," they argued.
They also said that they were made aware of some of her Instagram posts that were "extremely relevant to this case," but were never disclosed.
On her Instagram, they allege they found she was an "ambassador" for RUMA Aesthetics, the other facility the RHOSLC newbie claimed to have gone to correct her "botched" injections.
Instagram screenshots from December 2022 appear to show that Monica, who used her other last name at the time Dalgado, was an ambassador for RUMA Aesthetics.
Aesthetics from RUMA apparently gave depositions on January 12, 2024, but since they were held privately, they have not been released in court documents and it is unknown if they will be released.
Since Monica and her counsel now have until February 22, 2024, to produce discovery, Beauty Lab is asking the court to step in and order her to submit the requested material.
They are also asking that she pays for their attorney fees after the trouble they are going through to get Monica to respond.
MONICA DRAGS HEATHER
Attached to BLL's Statement of Discovery Issues, as reviewed by The U.S. Sun, is an exhibit that shows the children's clothing founder dragging Heather into her discovery.
She named Heather, included her Salt Lake City address - and not her telephone number since it was "unknown" - and claimed her Housewives co-star was a person who likely has discoverable information, as well as Beauty Lab's employees.
Monica stated at the time: "Ms Gay has knowledge of her relationship with Ms Fowler, the timing of the initiation of this action and the reasons for the filing of the Complaint."
The document Defendant's Initial Disclosures was filed on October 23, 2023, which would have been prior to the taping of the RHOSLC reunion on November 20.
'BOTCHED' LIPS
Monica had initially fired back at Beauty Lab in September 2023 by filing a counterclaim to their lawsuit for breach of independent duty of care, breach of contract, and breach of duty of good faith and fair dealing.
In the docs obtained by The U.S. Sun, she admitted she only made the payment of $449, but the reason why she didn't continue to make additional payments was because she believes she "received defective, negligently given injections, which did not have the intended, promised result."
Due to Beauty Lab's "botched" injections, she claims she had to go to another "competent party to fix the damage" to her nose and lips.
To help her argument, although the counterclaim has since been dismissed, she provided some evidence in the form of photographs.
In the Defendant's Initial Disclosures, which again was filed on October 23, 2023, Monica's attorney sent photos of her lips.
It is unclear what date the photos were taken, but either way, she appears to be pointing out her allegedly swollen lips, which she shows by pulling her top lip up and separately, her bottom lip.
In November, Beauty Lab filed a motion, claiming Monica was raving about BLL's services in DMs to an aesthetician from BLL.
The U.S. Sun has attempted to reach Monica's attorney for comment.
As of February 3, 2024, Monica's attorney has filed an objection to Beauty Lab's Statement of Discovery Issues and said that their filing is "not necessary and serves only to increase the parties’ attorney fees."
He also noted: "In fact, Fowler has produced all requested documents she was able to locate... Fowler has done her best to comply with the Requests for Production of Documents."
FIRED BY BRAVO
Monica and Heather had not brought up their nasty court battle on the show until part two of the RHOSLC Reunion, which aired on January 16.
Following an argument with co-star Angie Katsanevas, Monica got caught in a lie after she said she never sued anybody.
The Beauty Lab lawsuit was then brought up, and Monica said that she sued because Heather was suing her.
Angie screamed, "Why is it bad? Pay your f**king bill."
Monica fired back, "God damn. No!"
While both ladies were talking over one another, Heather chimed in saying that she was "doing it for collections."
The day that part three of the reunion aired, on January 23, it had been revealed that Monica, who has been outed as one of the few people behind Reality Von Tease, would not be returning for a second season.
Heather, for her part, has since commented on Watch What Happens Live and told Andy Cohen that she's looking forward to filming with her "actual friends."
