Kyle Richards and Mauricio Umansky's potential divorce battle could get messy as it's been reported that the couple have no prenup in place.
The estranged pair, who still live under the same roof, do not have any 'immediate' plans to legally end their 27-year marriage - nor have they consulted any lawyers, according to TMZ.
Mauricio, 53, who is the owner of real estate firm The Agency, and has a joint estimated net worth of $100million with wife Kyle, who stars on the Real Housewives of Beverly Hills.
However, Mauricio is the higher earner of the pair, having reportedly sold almost $5billion in luxury properties since founding The Agency back in 2011, after marrying Kyle in 1996.
In most California divorce cases, a judge would typically order the higher-earning spouse to pay alimony to the lower-earning spouse, irrespective of their gender, which in this case would undoubtedly be Mauricio.
Kyle, 54, is said to have been instrumental in Mauricio's money-spinning real estate career, as he was originally working in fashion before he met his wife.
He began working for Kyle's brother-in-law, real estate mogul Rick Hilton, who helped Mauricio get his foot in the real estate door, per TMZ.
Under California law, Kyle would be entitled to half of the marital assets and up to 40% of her spouse's income for child support, spousal support, and other terms of a divorce settlement.
While the pair may not be preparing to go to war just yet, Kyle recently referred to their split as a 'divorce' and not a 'separation,' while at BravoCon just days ago - sparking concern among fans.

'I've gone through a lot this last year that does change you. Losing my best friend to suicide changed me. Going through my divorce, all that has made me stronger but it definitely changes you as a person. I feel good,' she said at BravoCon according to TooFab.
She was asked if there was a chance of reconciliation during BravoCon, and she said she's taking it a 'day at a time.'
'I'm grateful that we get along so well and love each other very much and we're putting our family first,' Kyle said.
Adding: 'We're still living together under the same roof and I'm proud of the way that we are navigating through this. I just take it a day at a time.'
The couple wed in 1996, and announced their separation in July 2023.

The home, which is 11,000 square feet, is also called The Smokey Robinson Estate because he lived there from 1988 until 2002, per Entertainment Tonight.

The home was actually a listing of Mauricio - but Kyle said she 'fell in love' with the property.
Kyle and Mauricio were in the midst of redoing the floors at their Bel Air home when she stumbled upon his listing.
She wanted to look at the floors of the Encino home and when the couple went to see the home, they were 'completely blown away,' per the outlet.
Kyle and Mauricio lived in their Bel Air home since 2011 before deciding to move in 2017.
They put the 6,250 square-foot home on the market for $6.9 million that year, eventually selling the house in January 2022 for $6.1 million.
They also had an Aspen, Colorado vacation home, but they sold it in June 2022; it is a three-story duplex.
The couple purchased it in 2016; it features four bedrooms, five full bathrooms, as well as a rooftop deck - with scenic views.
They sold it in June 2022 for $9.75 million.
Kyle and Mauricio also own a home in La Quinta, California, which she gave a tour of for Bravo back in 2021.
The massive estate has scenic mountain and desert views, as well as of the golf course.

She and her estranged husband share daughters Alexia, 27, Sophia, 23 and Portia Umansky, 15. Richards' eldest child Farrah, from her relationship with her ex-husband Guraish Aldjufrie, works with Mauricio at The Agency.
The family often go on extravagant vacations together, including a recent trip to Europe aboard a yacht.
While speaking about watching the current season of RHOBH, she said it's been 'really hard' seeing her 'kids' faces' during 'those conversations.'
'I didn't even see last week's episode, I'm trying to watch it on my phone and was like, ugh, I'm getting stressed and then I forgot it was on,' the mother-of-four added. 'This is what happens after 13 years. I forgot to watch it and didn't even remember to post about it. So maybe that's a subconscious thing I'm doing. Its just gonna be hard to relive all that.'
Her remark comes after she admitted that she and Umansky were going through a rough patch on Wednesday's episode of The Real Housewives of Beverly Hills.
'I think he's poured his heart and soul into The Agency,' Kyle said in a confessional referencing Mauricio's ever-expanding real estate firm. 'So it's the other woman.'

'That was very hard to see. Yes, that hurt my feelings,' she said on Andy Cohen's late-night talk show, On Watch What Happens Live.
She added: 'Listen, I love him very much and we are amicable, but that really did hurt me.'
After she revealed she was affected by their public display of affection, sources told DailyMail.com exclusively that Mauricio and Emma are now trying to 'tone down' their 'budding romance.'
The insider also revealed their 'chemistry' is very much real and is anything but a 'showmance.'

'Like you really form a very, very special bond and I think we have similar personalities, so we've got a super supportive - last week was extremely emotional - so super supportive relationship, we definitely there for each other. It's beautiful, that's a great thing!'
Mauricio insisted the whole thing was overblown as he explained what had transpired: 'We're really good friends, and just to clarify we went to a restaurant to go get some sushi right after rehearsal, we were in our rehearsal clothes. Lots of the stories are wrong, lots of them.
'Yes, it's a very intense week, a very emotional week, we were talking about the week during dinner, and when we came out of dinner, we were recapping and I reached out to grab Emma's hand and she grabbed my hand, and then we walked to the cars, you know just recapping and summarizing, and then the paparazzi caught that moment and it's become a blown out moment,' he continued.
'And then all of the sudden we're dating,' Emma joked.

Since announcing his separation from his wife earlier this year, Kyle has been linked to country singer Morgan Wade, however, the duo have denied being romantically involved with one another.
Mauricio and Kyle announced they were splitting up after 27 years of marriage in July.
On Saturday, Kyle also opened up about her daughter Farrah Brittany and whether or not she's still engaged to Alex Manos, after rumors floated around they had ended their engagement.
While on the Two Ts in a Pod podcast - hosted by Real Housewives stars Teddi Mellencamp and Tamra Judge, Kyle said: ' I don't like to answer things for other people. I don't like to put people on the spot, but let me just call my daughter on the pod with the camera and on speaker. Let's see if she answers,' per Page Six.
Brittany didn't pick up, to which Kyle said: 'I'll let her speak for her own, you know, to that herself.'
