Artem Chigvintsev will not face criminal charges for his domestic violence arrest on August 29.
According to a new report, the Napa County District Attorney’s Office announced their decision against charging the 42-year-old Dancing With the Stars alum on Tuesday after prosecutors decided that there wasn’t enough evidence to prove Artem had violated the law.
TMZ shared the news on September 24, stating that the decision was made after the investigation into the incident, as well as evidence connected to the scene, was reviewed, and adding that the case would be revisited if new details arise.
Following the decision, Artem’s attorney, Dmitry Gorin, released a statement to TMZ.
“Mr. Chigvintsev has maintained his innocence from the beginning. He is grateful that the district attorney accurately assessed what took place, and determined he should not be charged,” he stated. “He enjoys tremendous support from the community, and requests privacy for the pending divorce matter. He loves his son, wants the best possible for him, and looks forward to the next chapter in his life professionally and as a father.”
While Artem was arrested for “injury to a spouse, cohabitant, or partner,” his now-estranged wife, Nikki Garcia, 40, was never officially named. However, she seemingly confirmed she was the victim as she quickly removed her wedding ring and filed for divorce.
As Nikki continued to request privacy, she was absent from the latest episode of her and her sister Brie Garcia‘s podcast.
“Nikki isn’t here because, as you all know, she’s going through something personal in her life,” Brie explained on The Nikki & Brie Show, via PEOPLE. “And she just asks for her privacy for her and her family, so we’re going to give that.”
“But she sees all the support and love. And we’re always grateful for all of your love and support, so thank you all for that,” she added, confirming Nikki will return next week.
Around the time of the podcast, Nikki and Brie stepped out for a shopping trip in Napa Valley, California, where Nikki was seen ringless.
Artem and Nikki were married in August 2022 and share one son, Matteo, 4. And when Nikki filed for divorce on September 11, she requested sole legal and physical custody and asked for the court to deny spousal support to both parties. Then, in his response, Artem requested joint custody of Matteo and spousal support from Nikki.
“At this time, Mr. Chigvintsev will not comment on any pending proceeding,” his attorney, Ilona Antonyan, said in a statement to PEOPLE at the time. “The parties are focused on co-parenting and working together for the best interests of their son.”
